
New York - A lawsuit was filed against McDonalds in late November due to an incident with a customer’s cell phone. Philip Sherman left his cell phone at the fast food restaurant, located in Fayetteville Arkansas, which incidentally contained nude photos of his wife, Tina Sherman.
Philip Sherman contacted McDonalds in attempt to regain his cellphone with the photographs intact. The employees allegedly assured Sherman that the phone would be secure until he could regain possession of it. Unfortunately, this was not to be. The racy photographs of Tina Sherman, their address, and number were all leaked to the internet by McDonalds employees, invading the customers’ privacy and ultimately humiliating them.
It was claimed that the pictures were posted on the internet with the McDonald’s logo and slogan. The pictures were posted in several places with Tina Sherman’s nude form and the McDonald’s slogan saying “I’m lovin’ it”. Causing more embarrassment to the couple, pictures were also posted stating that Mrs. Sherman was “as hot as McDonald’s coffee”.
The Sherman family is now seeking 3 million dollars through a lawsuit for damages against the McDonald’s chain, store manager, and franchise owner. They claim that the actions made by the fast food restaurant caused them embarrassment and emotional damage. Philip Sherman also claimed that due to the photos leaked to the internet, his wife had ultimately gained stalkers who sent crude letters, threatening calls, and text messages all about his wife’s nude pictures.
Philip also claims that they were forced to move out of their home to avoid these unwelcome calls, letters, and threats. The McDonald’s managers refused to comment on the incident, which has also caused McDonalds a high rate of embarrassment due to their employees actions. Most speculate that the pictures were posted by a teenage employee due to the humorous, yet degrading slogans posted along with the pictures. The photographs have now been removed from the original internet site that they were posted on. Unfortunately, the damage was already beyond repair.
Most use this as a lesson to keep their cell phone on their person at all times, and never, ever keep pictures that one would rather the public not see readily available for intrusion.

find the website where the pictures were posted if he hadn’t
put them there himself? He’s trying to scam McDonalds out of
some money.

The article said they recieved unwanted calls, letters, and threats. I am sure someone told them how they got the info. Thisnt like someone spilling coffee on their lap and then suing McDonalds because they “didnt know it would be hot”.

I’m with Ernie on this one. Just seems really convenient that he would lose his phone with nude pictures and then find them posted on the net. I wonder if any of the employees will make a statement or maybe even fess up to it, but that’s highly unlikely. Smells fishy, and it’s not their fish sandwiches.

they do deserve 3 million they had to move to a new home away from the scandal that was brought to then…. and why cant he have nude pictures of his wife…. its his WIFE…. pus if u read more into this the pictures werent save to the phone they were text messages and whoever posted the pictures online saved them onto his phone….. i think they were humiliated. i actually saw all the pics have you guys? If that where me i would have attacked the manager or whoever it was!

McD was obligated to preserve customer property. If customer had left wallet containing cash, McD would have analogous obligation to preserve cash. Opportunity to steal does not convey the right to steal.
BTW, McD liability for hyper-hot coffee was completely justified. Victim demonstrated that McD served hyper-hot coffee as a calculated ploy to reduce demand for free coffee refills, thereby reducing the probability that customers may linger at tables without additional purchase. McD research had demonstrated that customers are less likely to linger over a second cup, if hyper-hot coffee is too hot to drink. McD knew that hyper-hot coffee could cause injury. McD was liable for damages because McD intentionally created an unsafe situation which foreseeably caused harm.
Consider that McD could have followed the accepted practice of serving coffee that was safe to drink; and suffered the accepted consequence of customers lingering over refilled coffee.

Im sorry but this is kind of stupid. How does he know if Mc D. did this? For all we know, it could be someone else that found the phone and transfered the pictures and left the phone there and Mc D. gets the blame for it. It is his fault for leaving pictures on his phone and leaving his property at a public place where everyone can see it. It might be personal stuff, but maybe if he took care of his items that he carried, this wouldn’t have happend. Its a scam.
